LUIS BARRETO: The most common reasons for seeking to set a will aside are the person lacked the mental capacity at the time that they prepared the will, or the person was subjected to improper influence, or the person was, let's just say, fraudulently induced into making a will. They're usually brought by someone who was a beneficiary under a prior will and has somehow now been omitted in the newer version of the will.

Will contests cases are somewhat difficult because they're like filming a documentary after the fact. These cases do involve documents, but for the most part they are cases that turn on witnesses and their testimony. For the most part, witnesses are lay witnesses and this is the critical part of any will contest case.

People hire us because of our results. We work hard for our clients. We advocate for our clients. But we also take care of our clients and look after them during the course of the litigation.

I really enjoy this area of the law. I couldn't think of doing anything else other than this. I enjoy representing people, I enjoy righting wrongs. We like to consider ourselves the Robin Hood of probate. We always try to go after the people that stole rather than representing those that steal.
